Terms of use

1. Who you're contracting with

Harper is operated by Bond Design & Co Ltd, a company registered in England & Wales. Throughout these terms, "Harper", "we", and "us" refer to Bond Design & Co Ltd. "You" refers to the person or business using the service.

2. What Harper does

Harper is an AI marketing service that plans campaigns, generates copy and creative, builds draft campaigns in connected ad platforms (paused by default), and helps you launch and manage paid marketing. Harper never spends your money without your explicit approval.

3. Your account

• You must be 18 or older to create an account.
• You are responsible for keeping your login secure and for activity in your account.
• One account per person; one workspace per business at the current tier.
• If you connect ad accounts, you confirm you have authority to do so.

4. Acceptable use

You will not use Harper to:

• Generate or publish content that is illegal, deceptive, defamatory, infringing, or harmful.
• Run ads for products or services prohibited by the connected ad platforms.
• Make claims you cannot substantiate (especially in regulated categories — finance, health, etc.).
• Circumvent the approval gate to spend money without authorization.
• Reverse engineer, scrape, or resell the service.
• Send spam or violate anti-spam laws (PECR, CAN-SPAM, CASL, GDPR e-marketing rules).

We may suspend or terminate accounts that violate these rules.

5. Trials, billing, and cancellation

• New accounts receive a 14-day free trial. No charge during trial.
• If you do not select a plan by the end of the trial, Harper will disconnect from your ad accounts (your campaigns in those platforms remain unchanged). You can re-subscribe at any time.
• Paid subscriptions are billed monthly in advance via Stripe.
• You can cancel at any time from the billing portal. Cancellation takes effect at the end of the current billing period; no pro-rated refunds.
• Prices may change with 30 days' notice for existing customers.

6. Intellectual property

You own your content. Brand assets you upload and generated content Harper produces for you (copy, images, video, campaigns) are yours. You grant us a limited license to process and display them only as needed to run the service.

We own Harper. The Harper software, design, brand, and underlying models remain ours. You receive a non-exclusive, non-transferable licence to use the service for the term of your subscription.

7. AI-generated content

Harper generates content using large language models and image/video models. Generated output may occasionally contain errors, inaccuracies, or content that doesn't match your brand. You are responsible for reviewing and approving anything before it publishes. The approval gate exists for this reason. Do not publish content you haven't reviewed.

8. Spend authority

Every campaign Harper creates in your connected ad accounts is created in a paused state. No money is spent until you explicitly release the campaign inside Harper. You set daily spend caps; Harper enforces them. We are not liable for spend you authorize.

9. Service availability

We aim for high uptime but do not guarantee uninterrupted service. Maintenance windows, third-party platform outages, and force majeure events can affect availability. We do not provide credits or refunds for downtime at this stage.

10. Liability

To the maximum extent permitted by law, Harper's total liability to you under these terms is limited to the fees you paid us in the 12 months before the event giving rise to the claim. We are not liable for indirect, consequential, or special damages (including lost profits, lost ad spend, or lost leads). Nothing in these terms excludes liability for fraud, death or personal injury caused by negligence, or any other liability that cannot be excluded by law.

11. Termination

You can stop using Harper at any time by cancelling your subscription. We can terminate accounts for breach of these terms, non-payment, or if we cease to offer the service. On termination, you have 30 days to export your data; after that, account data is deleted in line with the privacy policy.

12. Changes to these terms

We may update these terms. Material changes will be emailed to active customers before they take effect. Continued use after changes means acceptance.

13. Governing law

These terms are governed by the laws of England & Wales. Disputes are subject to the exclusive jurisdiction of the courts of England & Wales.
